I have read with interest all the articles about the difficulties many settings are having due to delays in the Criminal Records Bureau checks for teachers and early years workers. I have to admit to being astounded at one thing. If you are being prevented from taking up employment because of a delay by a third party, can you not sue for loss of earnings?

I have to admit to being astounded at one thing. If you are being prevented from taking up employment because of a delay by a third party, can you not sue for loss of earnings?

As the manager of a nursery waiting for four police clearances, I can just about manage with my current staff and be secure in the knowledge that our systems are secure enough to employ staff and monitor them closely pending a successful result. But other settings are not so fortunate. Can businesses losing money through this delay not pursue the actual loss of income from the Government, whose systems have failed dramatically?

I think if one or two larger bodies were to pursue these lines of enquiry there might be a little more expediency in clearing the backlog.
