If asked, 'what regulations does a nursery need to comply with?' we'd all undoubtedly think of the Daycare Standards and Ofsted. However, there are many more generic, but sometimes lesser known, business regulations. Breaching them might incur a fine. And don't forget that once obtained, a licence will also need to be renewed.

Processing Personal Data

The Data Protection Act regulates how personal information is used. As well as covering information such as names and addresses, bank details and opinions expressed about an individual, it also includes capturing information on CCTV. To find out if you need to register with the Information Commissioner, complete an on-line self-assessment form at www.ico.gov.uk.

Collective Worship Copyright Licence

If you're planning on recording your nursery carol service or producing songbooks for parents/carers you may need a licence from Christian Copyright Licensing International. Copyright Licensing Agency Licence

To make copies of extracts from a majority of books and magazines protected by copyright you need a licence from the Copyright Licensing Agency. Prices are subject to change, with a Small Business Licence starting at less than £100 per year. Further information can be found at www.cla.co.uk.

Phonographic Performance Limited (PPL) and the Performing Rights Society (PRS)

The PPL licenses the performance of sound recordings in public. The PRS is responsible for the area of copyright dealing with the musical and lyrical content of a performance. Before playing copyright music in a public setting, it is worth clarifying the position with both organisations at www.ppluk.com and www.mcps-prs-alliance.co.uk.

Motion Picture Licensing Company

In addition to a TV licence you may also need to obtain a licence if you plan to broadcast video/DVD, at www.themplc.co.uk.
